SUBSCRIPTION AND SERVICE TERMS AND CONDITIONS

1. Purpose of the Service

CPCFY operates through a monthly subscription system that allows its clients to access services related to the creation, management, and distribution of content intended for digital media.

For the purposes of these Terms and Conditions, the “Service” primarily includes:

  • Drafting and preparation of press releases and other content.

  • Management and distribution of such content through digital media.

  • Access to CPCFY’s private platform, referred to as the “Internal Area”, application, or equivalent platform.

  • Additional features and services included in the plan purchased by the client.

The number of articles, publications, available media outlets, features, and other benefits will depend on the subscription plan purchased by the client.

2. Subscription

2.1 Subscription Start

The CPCFY subscription begins when the client successfully completes the registration process and makes the corresponding payment.

To access and maintain the Service, the client must provide:

  • A valid and current payment method.

  • Accurate billing information.

  • The information required to manage and provide the Service.

2.2 Content Approval

Before publication, the client must review and approve the content prepared by CPCFY through the Internal Area or through the established approval procedure.

CPCFY will not publish content requiring prior approval until such approval has been received from the client.

Once the client has approved the content, CPCFY may proceed with its publication and distribution in accordance with the Service purchased.

2.3 Duration and Automatic Renewal

Unless otherwise expressly stated in the purchased plan, CPCFY subscriptions are monthly and automatically renew at the end of each billing period.

The subscription will remain active until the client requests its cancellation.

If the client does not cancel the subscription before the next billing date, the client authorizes CPCFY to charge the applicable fee for the following billing period using the payment method associated with the account.

2.4 Specific Conditions

Certain plans, promotions, or services may be subject to specific conditions, prices, minimum terms, limitations, or features.

Where specific conditions apply, they will be communicated to the client before purchase, during registration, through the Internal Area, by email, or through a CPCFY sales representative.

In the event of any conflict between these Terms and specific conditions expressly accepted by the client, the specific conditions will prevail in relation to the relevant Service.

3. Billing Cycle

The subscription fee will be charged to the payment method associated with the client’s account on the applicable renewal date.

As a general rule, the monthly renewal date will correspond to the day of the month on which the subscription originally began.

For example, if a subscription begins on 10 December, the next renewal will normally take place on 10 January, and subsequently on the same day of each month.

The billing date may vary in certain circumstances, including:

  • Changes to the subscription plan.

  • An agreed change to the billing date.

  • Payment method issues.

  • Promotional periods.

  • Specific agreements entered into with CPCFY.

Where available, clients may consult information regarding their subscription and next billing date through their Internal Area.

4. Payment Methods

4.1 Valid Payment Method

To use a paid CPCFY Service, the client must maintain at least one valid payment method associated with the account.

4.2 Payment Authorization

By purchasing a subscription, the client authorizes CPCFY and its payment service providers to charge the amounts corresponding to:

  • The purchased subscription.

  • Subscription renewals.

  • Additional services expressly requested by the client.

If the primary payment method is rejected, expires, or otherwise becomes invalid, CPCFY may attempt to charge another payment method that the client has authorized and linked to the account.

4.3 Updating Payment Information

The client may update payment methods through the account where this functionality is available or by requesting assistance from CPCFY.

Certain payment service providers may automatically update payment information based on information supplied by the client’s financial institution.

Following any update to a payment method, authorization to charge the subscription fees will remain in force for as long as the subscription remains active.

5. Failed Payments and Outstanding Amounts

If CPCFY is unable to collect a subscription fee on the applicable payment date:

  1. CPCFY may attempt to process the payment again.

  2. Access to the Service may be temporarily suspended.

  3. Any amounts that are due and payable will remain outstanding, unless otherwise required by applicable law.

Failure to pay a renewal fee does not necessarily result in the immediate deletion of the account.

CPCFY may keep the account suspended until all outstanding amounts have been paid or until the account is otherwise terminated.

The client is responsible for keeping payment information up to date.

Bank charges, currency conversion fees, and other fees imposed directly by the client’s bank or payment provider are independent of CPCFY.

6. Prices and Taxes

The applicable price will be the price communicated to the client at the time of purchase or specified in the particular conditions applicable to the selected plan.

Where applicable, legally required taxes will be added to or included in the price, as appropriate and as indicated during the purchase or billing process.

CPCFY may modify its prices for future subscription periods.

Where a price change affects an existing subscription, the client will be informed before the new price becomes applicable where required by applicable law.

7. Subscription Cancellation

7.1 Right to Cancel

The client may request cancellation of the subscription at any time before the next renewal date.

Cancellation will prevent future renewals once the already-paid billing period has ended.

7.2 How to Cancel

The subscription may be cancelled:

  • Through the “Cancel Subscription” option within the Internal Area, where available; or

  • By sending a cancellation request to dfreire@economistas.net.

The request must include sufficient information to correctly identify the account or subscription to be cancelled.

7.3 Access Following Cancellation

Unless otherwise stated or unless suspension is necessary due to a breach of these Terms, the client may continue using the services corresponding to the already-paid subscription period until its expiration date.

After that date, the subscription will not renew.

8. Refunds and Unused Services

Unless otherwise required by applicable law, the specific conditions of the purchased plan, or a written agreement with CPCFY, fees relating to subscription periods that have already begun are non-refundable.

This policy reflects, among other considerations, the fact that CPCFY may allocate writing, support, management, and planning resources to the client’s account from the beginning of each subscription period.

Where a subscription plan includes articles, content, or services that may be used at a later date, failure to use them during a particular period does not automatically create a right to a refund.

Nothing in these Terms limits any mandatory refund, reimbursement, or compensation rights available to the client under applicable law.

9. Client Obligations

The client agrees to:

  • Provide truthful, complete, and up-to-date information.

  • Keep account login credentials confidential.

  • Use the Service only for lawful purposes.

  • Review content requiring approval before publication.

  • Ensure that any information, materials, images, trademarks, data, or other elements provided to CPCFY may lawfully be used.

  • Not use CPCFY to distribute illegal, fraudulent, misleading, defamatory, or otherwise unlawful content, or content that infringes third-party rights.

The client will be responsible for the content, information, claims, and materials directly provided to CPCFY.

10. Prohibited Use of the Service

Unless expressly authorized in writing by CPCFY, the client may not:

(i) Reproduce, distribute, modify, publish, commercialize, license, or create derivative works from CPCFY software, platform, databases, or proprietary content.

(ii) Remove, alter, disable, block, conceal, or bypass any security or content protection mechanism.

(iii) Use robots, bots, spiders, scrapers, or other automated systems to access the Service without authorization.

(iv) Decompile, reverse engineer, disassemble, or attempt to obtain the source code of any software forming part of the Service, except where expressly permitted by applicable law.

(v) Insert code intended to alter, interfere with, or manipulate the operation of the platform.

(vi) Conduct unauthorized data mining, collection, scraping, extraction, or mass reuse of data.

(vii) Upload, introduce, email, or otherwise transmit viruses, malware, malicious code, or any material designed to interrupt, damage, or limit the operation of the Service.

(viii) Attempt to gain unauthorized access to accounts, servers, systems, or information belonging to CPCFY or third parties.

11. Content Publication and Distribution

CPCFY will make reasonable efforts to manage the drafting and distribution of content in accordance with the purchased Service.

However, unless expressly guaranteed in writing as part of a specific plan, CPCFY does not guarantee:

  • Specific search engine rankings.

  • A specific number of website visits.

  • A particular commercial impact.

  • Sales, leads, or conversions.

  • Permanent availability of content on third-party websites.

  • That a third-party media outlet will not subsequently modify, archive, remove, or update a publication.

Digital media outlets and third-party websites retain control over their own platforms.

12. Platform Availability

CPCFY will make reasonable efforts to maintain the availability of the Internal Area and associated digital services.

However, access may occasionally be limited due to:

  • Maintenance.

  • Updates.

  • Technical issues.

  • Third-party provider issues.

  • Force majeure events.

  • Security measures.

Where reasonably possible, CPCFY will seek to minimize such interruptions.

13. Intellectual Property

The software, design, platform, trademarks, logos, databases, texts, and other proprietary elements of the Service are owned by CPC CAP PARTNERS – FZCO or are used under the corresponding licenses or authorizations.

Purchasing a subscription does not transfer any ownership rights in CPCFY’s platform or technology to the client.

Rights relating to content specifically created for a client will be governed by the conditions of the purchased plan and any specific agreement entered into between CPCFY and the client.

14. Suspension or Termination of the Service

CPCFY may suspend or terminate a client’s access to the Service in circumstances including:

  • Non-payment.

  • Fraudulent or unlawful use.

  • Serious breach of these Terms.

  • Use of the platform in a manner that may compromise its security.

  • Infringement of CPCFY’s rights or the rights of third parties.

Where reasonably possible, CPCFY will inform the client of the issue and provide an opportunity to remedy it before permanently terminating the Service.

15. Changes to These Terms

CPCFY may update these Terms and Conditions where necessary due to changes in:

  • The Service.

  • Subscription plans.

  • Payment methods.

  • The platform.

  • Applicable laws or regulations.

  • CPCFY’s operational requirements.

The updated version will be published on CPCFY.COM together with the date of the latest revision.

Where a change materially affects an existing subscription, CPCFY will inform the client where required by applicable law.

16. Governing Law and Jurisdiction

These Terms and Conditions and the relationship arising from the Service will be governed by the applicable laws of the United Arab Emirates and the Emirate of Dubai.

The parties will seek in good faith to resolve any dispute relating to the Service before commencing legal proceedings.

Subject to any mandatory rules of jurisdiction that may apply, any dispute arising from or relating to these Terms or CPCFY’s services shall be submitted to the competent courts of Dubai, United Arab Emirates.

Nothing in these Terms limits any mandatory rights that a client may have under applicable law.
